The Department of Justice announced on Friday that it will not pursue criminal charges against Attorney General Merrick B. Garland for defying a congressional subpoena to release audio recordings of President Biden’s interview by a special counsel. Yes, you heard that right, Merrick Garland has decided not to pursue criminal charges against Merrick Garland…need I say more, nonetheless I still will because this story gets far, far worse.
This decision was expected following President Biden’s invocation of executive privilege to protect the subpoenaed recordings from GOP lawmakers.
In a letter to Speaker Mike Johnson, oops, not that Michael Johnson, this Michael Johnson, Carlos Felipe Uriarte, Assistant Attorney General for Legislative Affairs, reiterated the department’s stance that it does not prosecute officials for contempt of Congress when the President asserts executive privilege over subpoenaed information. This privilege allows the executive branch to withhold certain internal communications deemed confidential under the Constitution.
Speaker Johnson expressed disagreement with the Justice Department’s position and announced plans to file a lawsuit compelling Mr. Garland to comply with the subpoena. This dispute arose after House Republicans voted to hold Mr. Garland in contempt and referred the matter to the Justice Department, escalating tensions over the disclosure of recordings from an interview conducted by special counsel Robert K. Hur. But his is where the real story begins. Based on the Republican’s line of questioning to Merrick Garland and others, there appears to be more to this story than meets the eye. Is it possible that the recorded interview with President Biden has been deleted, BleachBited, wipe outed, disappeared…terms that follow the Democrat party like a dog follows it’s master after they yell “I have treat for you” but of course later to be portrayed in every made for agenda movie, series and sitcom as a Republican issue. Just watch the new series of Amazon’s The Boys and see exactly what I mean.
So, we’ll continue on in just a minute as we move forward in the plot twist of the Hur investigation lost tape and Biden validating exactly why it’s such a big concern.
Hur’s investigation, initiated in January 2023 to probe the handling of classified documents during Biden’s vice presidency, concluded in a nearly 400-page report that there was insufficient evidence to prosecute Biden for retaining classified materials without authorization. The report noted Biden’s cooperation and contrasted it with former President Donald J. Trump’s refusal to return similar documents to government custody. However, we all know that there is much, much more to this story.

The word genuine in this context is beyond laughable.
The Justice Department defended Biden’s executive privilege, and their own against “baseless, personal and dangerous” attacks against the DOJ and the administration arguing that disclosing the recordings would hinder future high-profile criminal investigations where cooperation from White House officials is crucial.
Uriarte pointed out that previous administrations, including those of George W. Bush, Obama, and Trump, similarly upheld executive privilege in disputes with Congress.
Recent concerns have emerged however about the existence of the recordings sought by Republicans, with questions raised during congressional hearings about whether the audio files have been destroyed. What do they prove, show, or can be heard is paramount question the Democrats do not want answered.
Now there are questions about whether the audio has been destroyed.
“Are you comfortable, do you all feel the tapes still exist? Because they’re going to great extremes to prevent the American people from hearing it,” Rep. Ralph Norman asked during a House Rules Committee meeting last week.
“It’s my hope and it’s my understanding that they still exist,” House Oversight Committee Chairman James Comer replied.
